Terms of Service For Users

Fitvive and its affiliates ("Fitvive," "we," "our," or "us") own and operate websites, mobile applications, and related tools (collectively, the "Platform"), as well as services made available through the Platform (collectively, the "Services"). These Terms govern your access to the Platform and Services and form a binding agreement between you and Fitvive. Please read them carefully.

The platform and services are for persons 18 years of age and older.

You may not use our Platform or Services if you are under 18. Do not submit information about anyone under 18 without proper guardian authorization.

1. Services with Fitvive

Fitvive is a gamified move-to-earn health application. We help you track activity, complete missions, maintain streaks, collect digital sneakers, earn Stride Credits, and redeem eligible rewards through UPI where available. Fitvive is not a bank, cryptocurrency exchange, or medical provider. Rewards depend on your activity, account status, sneaker tier, mission completion, and applicable program rules.

Stride Credits are in-app reward units, not cryptocurrency or securities. The published conversion rate of 100 Stride Credits = ₹1 is subject to the Fitvive Credit Constitution, including notice and user-vote requirements for any material change.

2. Account registration

You must register an account to use most parts of the Services. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity under your account and for safeguarding your login credentials.

3. Privacy and data

By accessing the Platform, using the Services, or registering for an account, you agree that we may collect, process, and disclose your personal information in accordance with our Privacy Policy, available at fitvive.app/privacy.

4. Restrictions on use

You may not: (a) remove proprietary notices from any part of the Platform; (b) copy, scrape, or reverse engineer the Platform except as permitted by law; (c) use bots, scripts, or spoofed activity data to earn rewards; (d) create multiple accounts to abuse missions, referrals, squads, or leaderboards; (e) interfere with the security or operation of the Services; or (f) use the Services for unlawful purposes.

5. Rewards, pricing, and payouts

Earning rates, sneaker durability, mission values, subscription benefits, and payout thresholds may vary by plan, region, and program rules disclosed in the app. Fitvive may modify non-constitutional program mechanics with reasonable notice where required. UPI payouts are processed through authorized payment partners and may be delayed for verification, fraud review, or compliance checks.

6. Subscriptions, cancellations, and refunds

Paid plans, if offered, are billed according to the pricing shown at purchase. Subscription terms, renewal dates, and refund eligibility are governed by the policies displayed in the app and applicable app store rules. Redeemed Stride Credits and completed UPI payouts are generally non-refundable.

7. Health and safety

Fitvive encourages healthy movement. You are responsible for exercising within your physical limits and following medical advice. Do not use the Services while driving or in situations where tracking movement could create risk. Anti-cheat and health-first safeguards may reduce or remove rewards tied to suspicious or unsafe activity patterns.

8. Platform ownership and license

The Platform and its content, including text, graphics, software, sneakers, badges, and branding, are owned by or licensed to Fitvive and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

9. User content

If you submit reviews, squad names, profile information, or other content, you represent that you have the rights to do so and that your content does not violate law or third-party rights. Fitvive may remove content that is misleading, abusive, or inconsistent with community standards.

10. Communications

By using our Services, you consent to receive communications electronically, including service notices and account messages. If you provide a phone number, you may receive SMS for verification or important service updates. Standard messaging rates may apply. You can opt out of promotional messages by following the instructions in those messages or contacting contact@fitvive.app.

11. Disclaimer of warranties

The Platform is provided "as is" and "as available." Fitvive disclaims warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, specific earnings, or error-free reward calculations.

12. Limitation of liability

To the extent permitted by law, Fitvive is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our aggregate liability for claims relating to the Services is limited to the greater of the amount you paid Fitvive in the twelve months before the claim or ₹500.

13. Indemnification

You agree to indemnify Fitvive and its affiliates for losses, claims, or damages arising from your misuse of the Platform, violation of these Terms, or submission of unlawful user content.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in Hyderabad, Telangana shall have exclusive jurisdiction over disputes not subject to alternate dispute resolution required by applicable law.

15. Updates

Fitvive may update these Terms with notice where required. Continued use of the Platform after updates become effective means you accept the revised Terms. If you do not agree, you must stop using the Services.
